Argued is that he engaged in 1.25 years of egregious violations of a multitude of Massachusetts BAR conduct requirements. Violations include a repeated instances of severe negligence that were intended to deceive and entrap a client in order to earn money off of the client's case. Violations include egregiously poor communication skill, including creating a persistent context of hostility against his client, including failing to abide by the client's request to converse by telephone about matters that require back-and-forth exchanges (Cowan would resort to persistently emailing and dishonoring his client's repeated requests). Violations including calling, in writing, a client "sexist", regarding the client's objections to a 8 month vicious female landlord who engaged in substantial psychological abuse against the client. Violations including intentionally ill-preparing his client for his deposition, where he was interrogated for 2.5 hours by the opposing attorney - Cowan beforehand stated that the deposition would be benign and even boring, and the client was then shocked by 2.5 hours of unrestrained personal attacks, and Cowan did zero to support and defend the client during the deposition. Many other violations to be listed in the next few months in the context of the MA BAR complaint.
Also argued is that Cowan is concerningly lacking in basic empathy, and feigned superficial empathy while he substantially deceived and harmed his client over 1.25 years systematically.
Also argued is that Cowan derived persistent enjoyment by obsessively conveying to his client the opposing lawyer's hostile allegations about the client. Cowan persisted in doing this despite the client's repeated polite requests that he discontinue doing so. The client several times asked Cowan to refer to his hostile landlord as "landlord" or "former landlord", after Cowan for months would refer to the landlord by first name, or first and last name, and often 5-10 times in a brief conversation, and while referring to his own client as Mr. _____. Cowan objected to the client's request, but eventually agreed. Then Cowan returned to doing so. Cowan would often smile as he conveyed the opposing attorney's hostile allegations, and even repeat the allegations 2-3 times in 30 seconds, so as to persistently abuse his own client.
Argued to the MA BAR is that Cowan has a variant of Antisocial Personality Disorder.
Cowan was also observed by the client to have severe communicative problems with the opposing attorney and mediator, including extremely limited eye-contact (he would persistently shift his eyes back and forth to the wall, even shocking the mediator, who several times looked at the blank wall in order to see what he was looking at), was unable to provide concise and thorough summaries of the complicated landlord-tenant matter, etc.
Argued is that Cowan not only neglected, but objected to his client's repeated worries about the landlord engaging in retaliatory defamation, libel, slander, against him. Cowan failed to do anything, including sending the landlord a letter of warning about this. Months later the landlord began engaging in defamation and caused the client to suffer severe psychological and professional damage. Cowan then ignored this.
